Terms of Service

Article 1 (Application of the Terms)

  1. These Terms set forth important matters for the use of “JPP WEB SERVICE” (the “Service”) provided by JPP Inc. (“JPP”). Please carefully read and consent to these Terms before using the Service.
  2. These Terms may be subject to change without prior notice. In that case, the conditions for the Service shall be based on the Terms of Service after the change. The relevant changes shall become effective at the time JPP gives notice thereof by e-mail to the address notified to JPP in advance, a general posting on the jppjapan.com/jws/ site or by other methods deemed appropriate by JPP. If a change in the Terms of Service causes any disadvantage or damage to users, JPP shall not be responsible for it.
  3. Any viewing, use or downloading by a user of any content or information contained on the jppjapan.com/jws/ site shall be deemed as the user’s consent to these Terms.

Article 2 (User Registration)

  1. Prior membership registration is necessary in order to use the Service.
  2. The user shall manage the registered ID and password at its own risk, and JPP shall not be responsible for any damage incurred in relation to theft of the ID and password by any third party.
  3. If there is a change in the information registered, the user shall promptly change the membership registration accordingly.
  4. The user may not loan or assign its registered ID and password to any persons other than the user, and JPP shall not be responsible for any damage incurred in relation to the loaning or assignment of the ID and password.

Article 3 (Scope of Use of Information)

  1. The user of the jppjapan.com/jws/ site shall not use or make public the information it obtained through the Service in any way for profit or not, including by duplication, alteration, adaption, broadcasting, cable transmission, editing, publication, distribution and sale.
  2. The user of the jppjapan.com/jws/ site shall not cause any third party to use or make public the information it obtained through the Service for profit or not, including duplication, alteration, adaption, broadcasting, cable transmission, editing, publication, distribution and sale.
  3. However, there are services not falling under Paragraphs 1 and 2 that can be used by the user of the jppjapan.com/jws/ site. Those services shall be indicated as such within the Service.

Article 4 (Prohibited Acts)

The user of the jppjapan.com/jws/ site shall not engage in any of the following acts on the jppjapan.com/jws/ site:

  1. Damaging the [computer] system used for the Service or data stored therein;
  2. Transmitting or writing any harmful computer program, etc.;
  3. Infringing a third party’s copyright or other intellectual property rights;
  4. Libeling or defaming third parties;
  5. Causing any disadvantage to third parties, including violation of property and privacy;
  6. Engaging in a pre-election campaign, election campaign or other act similar thereto, or violating the Public Offices Election Act;
  7. Writing texts or transmitting pictures that are contrary to public morals;
  8. Conducting business activities or transmitting documents, programs or data, etc. for profit, without any contract with or the prior consent of JPP;
  9. Obstructing JPP’s business, including the administration of the Service;
  10. Conducting any act set forth in Article 3 without any contract with or the prior consent of JPP;
  11. Reporting false matters including its name and other membership information;
  12. Conducting any act that violates or is likely to violate laws or regulations;
  13. Conducting any act that JPP determines to be inappropriate with reasonable grounds;
  14. Materially affecting the [computer] system used for the Service;
  15. Causing significant inconvenience to other members in using the site for whatever reason;
  16. Obstructing the administration of the jppjapan.com/jws/ site or damaging the public’s trust in JPP; or
  17. Loaning or assigning the registered ID and password to any persons other than the user.

Article 5 (Temporary Suspension, Change and Discontinuation of Service)

  1. If JPP determines that any of the following events has occurred, it may temporarily suspend the service on the jppjapan.com/jws/ site without prior notice or consent:
    1. When conducting maintenance or modification of the system;
    2. When natural disaster or other emergency occurs or is likely to occur, whereby it would become difficult to administer the jppjapan.com/jws/ site; or
    3. When JPP considers it necessary to do so.
  2. Any service or information on the jppjapan.com/jws/ site or its URL may be subject to change or discontinuation without prior notice.

Article 6 (Handling of Copyrights)

The copyrights and other rights to the content posted on the jppjapan.com/jws/ site such as text, images, footage, sound and programs shall belong to JPP, and any duplication, reprint or other use of the content is prohibited.
JPP’s trademark, product name and service name, etc. used in the jppjapan.com/jws/ site are registered trademarks of JPP and the MBTI Association, and the use of these trademarks without the prior consent of JPP and the MBTI Association is prohibited.

Article 7 (Force Majeure)

If there is damage caused by a virus that cannot be prevented by ordinary antivirus measures or by natural disaster, or damage for reasons not attributable to JPP (“Force Majeure”), JPP shall not be responsible for the damage. JPP does not guarantee that any data resulting from the services on the jppjapan.com/jws/ site will not be deleted or modified due to a Force Majeure event, and the user of the jppjapan.com/jws/ site shall store such data at its responsibility as necessary.

Article 8 (Indemnity)

  1. If JPP has taken reasonable safety measures and nevertheless damage occurs for the following reasons, JPP shall not be responsible for the damage:
    1. Damage resulting from suspension, delay or discontinuation of the system due to a communication line or computer failure;
    2. Damage resulting from falsification of any web page within the jppjapan.com/jws/ site; or
    3. Damage resulting from unauthorized access to data relating to the jppjapan.com/jws/ site.
  2. JPP does not guarantee that the information and content on the jppjapan.com/jws/ site are accurate, updated, useful or complete.
  3. The jppjapan.com/jws/ site shall be used by the user at its responsibility.
  4. JPP shall not be responsible for damage incurred by the user of the jppjapan.com/jws/ site or third parties from the use or inability to use the jppjapan.com/jws/ site or other damage arising in relation to the Service, unless such damage is ordinary and direct damage, and caused intentionally or by gross negligence by JPP.

Article 9 (Suspension of Use)

If the user engages in any of the acts listed in Article 4, or JPP determines that the user violates any provision of these Terms, JPP may suspend its membership without prior notice to it.

Article 10 (Compensation for Damage)

If the user causes damage to any third party by its use of the Service, the user shall settle the case at its own responsibility and cost, without causing any damage to JPP. If the user engages in any of the acts listed in Article 4, or the user causes damage to JPP by its act in violation of these Terms or an unfair or illegal act, the user shall compensate JPP for the damage.

Article 11 (Links)

If you wish to have your website linked to JPP’s website, please inform us of your name, contact address, content and purpose of your website and URL of the page to be linked in advance. However, we will reject links to the following websites or those similar thereto:

  1. Links from a website that damages the public’s trust in or integrity of JPP such as a site contrary to public morals;
  2. Links from a website that libels JPP and/or its related companies and associated companies;
  3. Links from a website that libels JPP’s officers or employees; and
  4. Links that lead to the misconception that it has ties or cooperates with JPP or that JPP approves or supports the website from which the link comes.

Our site may include links to Internet sites owned and administered by third parties (“External Site”). We are not liable for the content of External Sites. If you have any question about External Sites, please contact to the administrator of the relevant External Site.

Article 12 (Handling of Personal Information)

This site may require the user to register its personal information in order to use our service. The collection, use and management of registered personal information shall be left to our discretion as long as we handle it appropriately in accordance with our Privacy Policy.

Article 13 (Governing Law and Jurisdiction)

  1. Interpretation and application of the jppjapan.com/jws/ site and these Terms shall be governed by the laws of Japan.
  2. Any lawsuit relating to the jppjapan.com/jws/ site shall be referred to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

Supplementary Provision
These Terms shall take effect as of April 6, 2010.
